TERMS & CONDITIONS

MEMBERSHIPS 

To purchase MEMBERSHIP, log into your Push Press account, go to Memberships and choose MEMBERSHIP. You can also contact the studio to set you up.

  • MEMBERSHIP holders are limited to 1 reformer and 1 mat based class per day.

  • The MEMBERSHIP auto-renews weekly, so you authorise Prack Pilates to charge your credit card on file for the purchase of MEMBERSHIP at the then-current price (in other words, if the price of the MEMBERSHIP changed during your previous month, you will be charged the new rate when auto-renewed).

  • We reserve the right to increase fees for ongoing memberships at any time. We will notify you in writing of any changes to the pricing details of the membership.

  • If you are paying for your membership by direct debit, you authorise us to debit any increase fee amounts from your nominated bank account. If you do not agree to any pricing changes, you may cancel your membership in accordance with these Terms and Conditions.

  • Each payment is non-refundable.

  • The sale of a membership is final. To the extent permitted by law, we do not offer any refunds on the cost of a membership for change of mind, user error, injury, illness, change of address, unsuitability or any other reason.

  • It is the holder’s responsibility to ensure there are sufficient funds available in their nominated bank account or credit card to cover the applicable fees for the Debit Memberships.

  • If a payment is declined for any reason, Prack Pilates reserves the right to process payment anytime where sufficient funds are available in the nominated bank account or credit card in order to settle any fees that are owed.

  • If an auto-debit is declined due to insufficient funds, our payment provider will charge a $14.90 dishonour fee for any failed transactions.

  • Bookings will be suspended until payment is made.

  • Prack Pilates is in no way responsible for additional fees that a holder may incur from their bank in relation to processing payment of fees for Debit Memberships.

  • By creating a Debit Membership, the holder agrees to the terms and conditions of our third party biller, currently Paychoice.

  • If you are on the MEMBERSHIP and you no-show to your class, you will be charged $30 no show fee. If you late cancel (i.e., cancel with under 6-hours’ notice) for a class, you will be charged $15.

BOOKING A CLASS

  • Bookings open 7 days prior to class.

  • Please arrive 10 minutes before your Pilates class as late entry is not permitted.

  • We require at least two clients for a Pilates or yoga class to operate.

  • If there are less than two, we will contact you to let you know if the Pilates or yoga class will be cancelled. Classes will be credited back to your account in this event

  • SOCKS & TOWELS ARE MANDATORY IN ALL CLASSES

CANCELLING A CLASS

  • We do understand that sometimes unforeseeable circumstances can arise, but we must be strict, consistent, and fair with all clients. Therefore, NO exceptions will be made to this policy.

  • If you have booked to attend a class and wish to cancel your attendance, you must process a cancellation through the Online Booking System only.

  • In order to cancel your attendance without penalty, you must process a cancellation using the Online Booking System up to 6 hours prior to the scheduled commencement time for the class as detailed in our Class Schedule.

  • If you fail to cancel your booking at least 12 hours prior you will forfeit that class, with memberships automatically charged a $15 late cancellation fee.

  • If you simply do not show for your booking, you will be automatically charged a $30 no show fee. Please note: bookings cannot be accepted without a credit card on file.

  • The late cancellation and no-show fees are non-refundable.

  • It is your responsibility to cancel your classes.

The cancellation policy is in place to ensure everyone has a chance to attend. 

WAITLIST

If a Pilates class you wish to attend is fully booked, please add your name to the waitlist.

  • If a place becomes available, you will automatically be added to class and an email confirming your promotion will be sent.

  • When you place yourself on the waitlist, you are committing to the class should you get in.

  • The 12-hour cancellation policy applies to those who have put themselves on the waitlist for a class also.

  • If you book a group Pilates class and fail to cancel your booking at least 6 hours prior, you will be automatically charged a $15 late cancellation fee (with the exception of class pass holders who will lose a class).

  • If you know you will not be able to make a class that you have waitlisted yourself on, it is your responsibility to remove yourself from the waitlist.

  • It is the client’s responsibility to check in as to whether they have moved into the Pilates class or are still on a waitlist.

RUNNING LATE?

  • Please keep in mind, we do not allow clients into class after the 5-minute mark.

  • This is for your own safety as you will have missed the warm-up and to stay respectful to other clients and teacher already immersed in the active class.

  • This will be classified as a no-show.

  • There are no exceptions to this rule.

NEED TO LEAVE EARLY?

We do ask that all clients stay until the very end of class. Leaving early distracts other clients, disrupts the class, you won’t be there to wipe down your apparatus and let’s be honest- stretching is so great for your body, so take that moment for yourself! If there is a time when you know you must leave early (and you aren’t a frequent, please tell the teacher beforehand and we completely understand and will anticipate that happening that day for you and everyone else.

PUTTING MEMBERSHIPS ON HOLD

  • Minimum hold period of 2 weeks.

  • There is a maximum of 8 weeks per year you can put your membership on hold with no fee.

  • Please email the studio a minimum of 7 days prior to place memberships on hold.

  • Suspensions will not be accepted via Facebook, telephone, in person or any medium other than via the email at hello@prackpilates.com.

  • NO EXTENSIONS OR HOLDS FOR CLASS PASSES.

CANCELLING MEMBERSHIP

IF YOU WANT TO CANCEL YOUR FORTNIGHTLY MEMBERSHIP AT ANY POINT, EMAIL HELLO@PRACKPILATES.COM ATLEAST 14 DAYS PRIOR TO THE EXPIRATION OF THE CURRENT FORTNIGHT, AND WE WILL CANCEL THE AUTO RENEW.

  • Suspensions and cancellations will not be accepted via social media, telephone, in person or any medium other an e-mail sent to hello@prackpilates.com.

CLASS PASS EXTENSION

Prack Pilates allows a generous three months to use a 10-class pass. We have a no extension policy, which means all sessions need to be used during these time periods. This is very achievable and provides motivation to practice regularly.

We often get asked to extend for holidays. Being a small business, this just isn’t viable. So please be aware of this when purchasing a class pass and use them all up before you jet off. This may just make you get on a reformer more than once a week too, so that’s always a good thing.

Casual classes have an expiry of 30days.

Prack Pilates, ABN 37 194 507 516, address (110-112 Terralong Street, Kiama NSW 2533). This form must be read, understood, correctly completed and accepted as indicated by properly signing, prior to participating in any Prack Pilates activity. If you are under 18 referred to as a Minor, you will need to have a parent or guardian who is over 18 sign on your behalf and provide contact details. Access to Prack Pilates activities is by payment and subject to Prack Pilates discretion. By participating in any Prack Pilates activity you accept the rules and regulations including participating in a safe manner. 

Rules and Regulations:

Prack Pilates activities, whilst care is taken, are not without risk which I/we accept, and in turn indemnify in full, on a solicitor and client basis, Prack Pilates, it’s Directors, employees, contractors, instructors, agents and nominees against all liabilities, damages and costs arising from Prack Pilates activities. This includes but is not limited to, liabilities arising from any cause such as negligence, contract, statute including the Civil Liability Act 2002, tortious or common law for any injury, death, loss, property damage or expense arising out of or sustained to me or I cause or my Minor causes, in the course of my or my Minor’s participation in the activities and programs offered by Prack Pilates, both on and off of the Prack Pilates premises or in relation to any activities, including to any party. Such activities include yoga, pilates, mediation classes. I agree that Prack Pilates is not responsible in the event of loss, damage, unauthorised use, theft or injury resulting from and to any personal property that my Minor or I bring onto or undertake on the premises. I also confirm that my or my Minor’s health is sufficient, and has no illness, injury or ailments which will prevent participation in Prack Pilates activities in a safe manner without risk to me or the Minor or others. I recognise that this Agreement and Release and Waiver is a legal instrument and that it is intended to be as broad and inclusive as permitted by Australian law. Prack Pilates’s liability in the aggregate is the refund of the fees paid for the Prack Pilates activity. I recognise that by signing this document I am waiving certain legal rights, including the right to sue and I sign it of my own free will and assume all aspects of the risks involved on behalf of my Minor or myself.
